Terms of Use Agreement

IMPORTANT: Before downloading, accessing, or using any part of a website owned or operated by Zincs for Boats or one of its affiliates or subsidiaries (together, “Zincs for Boats”), you (identified herein as “you” or a “User”) should read the following terms and conditions contained in this Terms of Use Agreement (“TOU” or “Agreement”) carefully, as they govern your access to and use of a website owned or operated by Zincs for Boats and any programs, services, products, materials, or information available thereon or used in connection herewith (collectively, the “Site”).

1. USER OBLIGATIONS

By downloading, accessing, or using the Site in order to view our information and materials or submit information of any kind, you represent that you are at least eighteen (18) years of age (or the age of majority in your state of residence). You agree to abide by all applicable local, state, national, and international laws and regulations, including U.S. export and re-export control and economic sanction laws and regulations, with respect to your use of the Site.

You also acknowledge and agree that use of the Internet and access to the Site is solely at your own risk. You are responsible for maintaining the confidentiality of any account number, account name, user ID, and/or password used in connection with the Site. Confidentiality of any communication or material transmitted over the Internet cannot be guaranteed; accordingly, Zincs for Boats is not responsible for the security of any information transmitted to or from the Site. Zincs for Boats reserves the right to prohibit or terminate access to the Site at any time, without notice, for any reason whatsoever.

2. LICENSE GRANT

This TOU provides to you a personal, revocable, limited, non-exclusive, royalty-free, non-transferable license to use the Site conditioned on your continued compliance with the terms and conditions of this TOU. You may print and download materials and information from the Site solely for your personal, non-commercial use, provided that all hard copies contain all copyright and other applicable proprietary notices.

3. RESTRICTIONS

You may not modify, translate, decompile, create derivative works of, copy, distribute, disassemble, broadcast, transmit, publish, remove or alter any proprietary notices or labels, license, sublicense, transfer, sell, mirror, frame, exploit, rent, lease, private label, grant a security interest in, or otherwise use any content on the Site in any manner not expressly permitted herein.

Additionally, you may not:

  • Use any “deep link,” “page scrape,” “robot,” “spider,” or other automatic device, program, script, or algorithm to access, acquire, copy, or monitor any portion of the Site.
  • Attempt to gain unauthorized access to any portion or feature of the Site, other User accounts, or any systems or networks connected to the Site by hacking, password mining, or any other illegitimate means.
  • Probe, scan, or test the vulnerability of the Site or any network connected to the Site.
  • Reverse look-up, trace, or seek to trace any information on any other User or visitor to the Site.
  • Take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or Zincs for Boats' systems.
  • Use any device, software, or routine to interfere with the proper working of the Site or any transaction conducted on the Site.
  • Forge headers or manipulate identifiers in order to disguise your identity or the origin of any message sent on or through the Site.
  • Use the Site in an unlawful manner or in a manner that could damage, disparage, or negatively impact Zincs for Boats.

4. PROPRIETARY RIGHTS

This TOU provides only a limited license to access and use the Site. Zincs for Boats transfers no ownership or intellectual property interest to or title in the Site to you or anyone else.

All text, graphics, user interfaces, visual interfaces, photographs, sounds, artwork, computer code, programs, software, products, information, and documentation—as well as the design, structure, selection, coordination, expression, "look and feel," and arrangement of any content contained on or available through the Site—are owned, controlled, and licensed by Zincs for Boats and its successors and assigns, and are protected by law including, but not limited to, United States copyright, trade secret, patent, and trademark law.

5. ONLINE PURCHASES & THIRD-PARTY SERVICES

Additional terms and conditions, including our Shipping Policy and Return Policy, apply to the purchase of products and services on the Site and are incorporated into this TOU by reference.

Translation Services: The Site may offer Google™ Translate or similar third-party tools to assist users with language translation. Google™ Translate is an automated service, and translations cannot be guaranteed as exact or accurate. Users utilizing translated content do so at their own risk, and Zincs for Boats is not responsible for damages or issues arising from translated content.

6. DISCLAIMER OF WARRANTIES

While Zincs for Boats endeavors to provide accurate, up-to-date, and reliable information, products, and services, all materials and services on or available through the Site are provided on an “AS-IS” and “AS AVAILABLE” basis.

Zincs for Boats makes no representations or warranties of any kind, express or implied, regarding the suitability, completeness, timeliness, reliability, legality, or accuracy of the information, products, or services available on the Site. To the fullest extent permissible by law, Zincs for Boats disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Zincs for Boats does not warrant that the Site will operate error-free or uninterrupted.

7. LIMITATION OF LIABILITY

You expressly release Zincs for Boats and its affiliates, officers, directors, employees, agents, and attorneys from any claim of harm resulting from causes beyond Zincs for Boats' direct control, including electronic or mechanical equipment failures, communication line errors, telephone connection issues, unauthorized access, theft, operator errors, severe weather, natural disasters, strikes, labor disputes, or carrier transit delays.

In no event shall Zincs for Boats be liable for any indirect, punitive, incidental, special, or consequential damages arising out of or connected with the use of the Site, delayed delivery, or inability to use the Site or products ordered thereon. To the maximum extent permitted by applicable law, the total liability of Zincs for Boats for any reason related to the use of the Site or purchases made thereon shall not exceed the total amount paid by you to Zincs for Boats in connection with the subject matter of the dispute.

8. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Zincs for Boats, its affiliates, officers, directors, employees, agents, and successors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your breach of this TOU or misuse of the Site.

9. GOVERNING LAW & JURISDICTION

This TOU constitutes the entire agreement between you and Zincs for Boats regarding the Site and supersedes prior communications. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

10. UPDATES & MODIFICATIONS

Zincs for Boats reserves the right to revise these terms at any time by updating this posting. By continuing to use the Site after updates are posted, you agree to be bound by the revised Terms of Use.
